Consignor/Seller Agreement & Protocol

The website is YOUR selling PARTNER. Please familiarize yourself with it. Thank you

IMPORTANT CHANGES effective immediately for this CURRENT CYCLE running March 1, 2024 through MAY 31, 2024

registration fee - increase from $10 to $12

Percentage payout to consignors has changed as follows and effective immediately for current cycle March 1, 2024 through May 31, 2024. The following payout percentages to consignors will apply immediately:

items selling for $199 and under = payout 50%

items selling for $200 and over = payout 60%

**** Also, beginning NEXT CYCLE, this agreement will be revisited to anticipate further adjustments. PLEASE BE ADVISED and see details below.

If you wish to pick your items up and remove from this upcoming cycle March 1, 2024 through May 31, 2024, to avoid early pick up fee of $12, please call to schedule a pick up time and pick up by MARCH 16, 2024. Call before coming so I can have your items ready. All other fees in the fees list apply.

****After this cycle, please be advised that I will be revisiting this agreement again after this current cycle and DO anticipate to make adjustments to payout percentage to all consignors beginning next running cycle. Though I have not fullty decided on the exact changes, I do anticipate forthcoming changes to include payouts to consignors to decrease to 45% (for items $299 and under), 50% (items $300 -$800), and 55% (items over $800) of the sales price, with no registration fee deducted.  I increased the percentages for the past several cycles to study the outcome, and though I am glad to consign and appreciate all of my consignors, after having studied the results, I can see that the higher payout payout for the past few cycles has not been a good business model on the financial end so it is time to make necessary adjustments. If this anticipated change clashes with your ideal expectations, I understand if you need to pick your items up and will not take it personally. These changes are subject to begin next cycle.

Consignment Agreement (aka seller agreement/contract) and Protocol Policy for Boutique Galleries or Formal Fair Consignment has been last revised/updated on 2-29-24 to reflect changes in percentage payout and registration fee. (sections titled "Registration Fee"/List of Service Fees) to reflect a change from $10 to $12 for the nominal registration fee, deducted from your check for sold items. There is still no registration fee if no check is forthcoming to you.

You must be at least 18 years of age to consign with Boutique Galleries. If you are not 18, please have a parent or legal guardian to consign on your behalf. By agreeing to this contract, you are stating that you are 18 or older and are independent from any legal guardian.

Registration fee - see fees list below for current fee. This is subject to change from cycle to cycle, but will remain consistent within the duration of the cycle.
  1. Unless otherwise stated per individual agreement, all consignors will pay a consignor fee to be deducted from total earnings for items sold (or rented) per consignment cycle. This fee offsets the cost of operation in handling your merchandise, display bag/hanger, paperwork, software needed to tag and scan your items, extra workers to handle your items, checks, envelopes, postage, etc. This fee will be charged per cycle only if an item sells/rents during the that cycle and you will be receiving a check. This is in lieu of charging the fee upfront when registering.
    1. The exception to having this fee deducted is if an item is picked up early and in such case the current registration fee is to be paid immediately at time of pick up. No item will be allowed to leave with you until all fees with Boutique Galleries are settled.
    2. This fee will include Boutique Galleries manually registering/moving items from inactive to active status for all consignors who have 1 or more item(s) to sell per given cycle and will receive a check (*No check will be written if it does not cover more than all remaining fees on the account). For returning consignors, this act will not occur until the end of the cycle payout when it is time to reconcile sales data and upload that data online. You are still welcomed to register yourself, but there is no advantage except for your own satisfaction.

Payout Percentage
  1. Please see the homepage for the current payout percentage to consignors. Though percentage payout is subject to change from cycle to cycle, Boutique Galleries commits to the same consistent percentage, as stated on the homepage, to all newly registered consignors throughout any given cycle.
  2. Percentages apply per cycle per registered consignors, regardless if you personally register or you were registered by Boutique Galleries.

SELLER AGREEMENT

  1. For all Consignors, both new and returning, before registering for a consignor ID# and entering items into the system - you must agree with this Consignment Agreement/contract and protocol. If you have an issue with any segment of this agreement, please contact us before signing up to consign. While we are glad to consign your items, we first and foremost are an operating storefront business. Store routines must presume as normally as possible. We appreciate your understanding.

Your active account
  1. Once I see that you have no items left here for sell and have cashed your last check, I will delete your account from the system. So if you have other item(s) to bring in, you'll need to register all over again and add your profile information. If you do want to add items, let me know ahead of time so I will leave your account active.

Active vs. Inactive Status of consigned items
  1. A consignor must be registered and items active in order for the scanner to read its bar code to give the consignor credit for the sale
  2. When you enter items into your inventory, they are automatically entered into your ACTIVE INVENTORY. They will remain there unless you manually remove them or when the cycle is over (explanation below)
  3. At the end of the consignment cycle, sales are reconciled, updated, and uploaded online so you can then view a list of your sold and unsold items.
  4. This data upload causes the system, by default, to automatically move ALL consignors to non-registered status and ALL inventory to inactive status.
  5. The consignor MUST be registered AND items MOVED form INACTIVE to ACTIVE status in order for the ticket to be scanned to record sales. As stated at the beginning, Boutique Galleries will now commit to do this for you as part of the regular registration fee, but you are welcomed to do this on you own.  agrees to register and/or move items to active status for the consignor as part of the regular consignment fee.
  6. By default, the point of sale software system will automatically delete any items that have had no activity within the last 2 years. This means if there was no data input for a particular consignor within the last 2 years, the system assumes that the inventory for that consignor has been abandoned and automatically deletes them to keep the system cleaned out. This does not necessarily mean that they have been deleted from inventory here at the store. When I go to scan a ticket for a sold item, if I see that it is not in the inventory for that consignor, I have the option to add a single line description, which I will do.

TO CHECK YOUR INVENTORY:

  1. Login at http://boutiquegalleries.blogspot.com/
  2. Go to your consignor login homepage
  3. Click the Activities Menu at the top left under your name.
  4. Click the arrow and then click to work with your consigned inventory
  5. Inventory will be either inactive or active. ALL inventory automatically moves/defaults to inactive status every time data is uploaded online (or at the end of every cycle at payout). In the inactive inventory, you should see your inventory that has yet to be added to the current consignment cycle. You will have a choice to make all inventory active. Please note, this will work only after the site is enabled for the current registration cycle. See below for more details on this.

Consignor Earnings/Pay out on Mark Downs/Payout Schedule
  1. Payment to consignors will be a percentage split for sells or rentals. Of the sell price, consignors receive the current percentage (subject to change per cycle to cycle, depending on circumstances) or 20% of the rent price (We rent only IF you agreed to rent your item or Boutique Galleries is willing to purchase your item). All payments to consignors will be mailed to address on file, generally within (2) weeks of the end of the consignment cycle. If you choose to donate your remaining items so that you will not be picking up your items, your check will generally be mailed within (2) weeks. See more information below or above.
  2. Please note, I am continually clearing out older items (particularly any items consigned 2 or more years ago, or 8 full season cycles or more). Any unsold/unrented items within this range are particularly subject to being moved to our storage area, and/or marked down drastically to sell in store or online (Note, for any item that sells online, there is an extra 20% fee deducted per such item from the consignor's check to help cover online fees and our time to list/package/ship the item), and/or discarded/donated/and account deleted.
  3. Such items will be handled in 1 of the following ways, according to how it applies:
    1. Items of consignors who fall in the category of usually 2 years cycles or more with no activity may be considered for immediate $15 or under markdown sale/donation. For any such item that sells at reduced mark down price of $15 or less, no payout will be given to consignor. For any item that falls within this category and the consignor has not picked up, it is assumed by Boutique Galleries that the consignor agrees to these terms and no longer wants these items nor is interested in keeping up with them. For such items, there will be no further payout or contact of any kind regarding this matter. Thanks so much for helping to make the business run smoothly.
    2. After consignor's payout percentage is calculated and any due fees are deducted (at end of cycle), if ticket sales leave the consignor with a check of $10 or less, Boutique Galleries will hold onto your sold tickets in hopes of adding them to other ticket sales in a future cycle. If no other sales are forthcoming, this is unfortunate but there would be no payment to consignor in such case. This is not the norm but does happen occasionally, particularly if you incurred miscellaneous fees (seamstress, cleaning, and/or items are heavily discounted or posted/sold online in order to sell them.

Items to consider for consignment must follow these conditions:
    1. clean - If your needs cleaning, we can clean it for you for a nominal service charge (generally $5-$25. fees list is below). We will NOT display to sell unless clean
    2. excellent to very good condition - must have all closures intact (hooks/eyes, etc). We can add for small fee.
    3. up to date style - typically within fashion season of a year or less is ideal. Some styles remain a little longer. Any Vintage item automatically goes to our storage area to list online as time permits.
    4. Single clothing items should be valued at $40 or more to consign or most likely will be rejected. Single accessory items must be valued at $10 or more to consign or most likely will be rejected.
    5. Boutique Galleries representatives reserve the right to refuse any item for any reason, especially if stained, damaged or is not in fashion with the items we want to keep in inventory.
    6. Boutique Galleries representatives reserve the right to change price of any item, especially if item is under-priced or over-priced for our selling market.

    Describing an item
    1. When entering the description of your items, please be as detailed as possible, such as category/size (drop down boxes), brand, style number, color, fabric, etc. If we happen to find a misplaced tag, we need to be able to go directly to the item by its description. The description boxes do not allow a lot of room for text characters, so use short cuts such as abbreviating and not skipping spaces. Ex: type: dBridalGrnChffnEmpWst (to describe David's Bridal Green Chiffon Empire Waist)
    2. NOTE. if you change any item's description or price, the ticket barcode is changed so the old ticket (the ticket on the item) would not be able to scan. So please do not do this. It is quite frustrating when trying to scan the ticket for the sale.

    Pricing an Item
    1. When pricing an item, consider alterations made to the width or length. These factors usually devalue a dress, and the price for alterations should not be included in the ticket price. That's a loss the original purchaser must bear. Please type or hand write any alterations to size. Ex. If dress was purchased as a size 10 but altered to fit smaller, write this in the description or hand-write it on the ticket.
    2. It is not unusual to take several cycles to sell an item, so when considering price, consider the absolute lowest you are willing to sale your item for. Then mark it in the description to discount to that amount. This does not mean it wouldn't sale for more, but this gives us a range of options without having to call you in the selling process to ask your new low. My advice is this: Gowns are like anything else, when the trend has gone, it's gone, so price it at your hopeful high mark but be willing to mark it lower if necessary to help entice a sell.
    3. If you check the box to reduce, it means you are willing to reduce it 50%.
    4. If you are willing to discount an item, but not as much as 50%, (or maybe more in some cases), I suggest to add the discounted percentage (D%) as part of your description.  Type D and the % (percentage) you are willing to discount it.  Ex: If I am selling my last year's Sherri Hill gown, I hope to get $300 so I put $300 for the sell price, but am willing to sell it for $240 if necessary, so in the item's description, I put D20%. That means it would discount up to 20% of $300 (or $240). This signifies to us that the consignor would like to sell the item as close to the $300 price as possible, but is willing to go as low as $240 if necessary in order to sell it, and we would most likely not sell it below $240 in the first consignment cycle. But any item that has not sold in the first cycle is immediately considered for markdown to its highest discount percentage and possibly more. Generally, the longer it sits unsold/unrented, the higher the markdown.
    5. If an item has been here for one or more cycles, we may continue to mark it down, using experience and discretion, even below your low price, to help the item sell, especially if it has seen it glory days already. We may even take an offer on it. Sometimes a low offer is better than no sell at all. This is particularly true if there have been custom alterations.
    6. If you change any item's description or price, the ticket barcode is changed so the old ticket (the one on the item) would not be able to scan to record the sale. So please do not do this. It is quite frustrating when trying to scan the ticket for the sale.

Renting an item vs Selling your item
    1. Renting is another option for your item to earn you money. We pay consignors 20% on ALL rentals unless the same item also sells in the same period/payout cycle. if the item only sells or also sells, the consignor would receive the agreed percentage of sale price for that item.
    2. If you wish to rent, as well as sale your item, write this into your item description. For example, If I price my item to sale for $300, but would rent it for $150, I would write in the description box RENT $150." or R$150. This could earn the consignor $$ and we take full responsibility of any rented item. Consignors earn 20% of rental price vs the current percentage of the sale price. *NOTE, if the item rents and also sells in the same cycle, only the sell price percentage will be paid to you.

Item Drop Off/ Consignment Time Line/ Item Pick Up after the consignment cycle has ended
    1. Items may be dropped off during normal business hours, but please do not plan to drop off on a Saturday without first making an approved appointment. We will print 2 copies of the inventory sheet. We both will sign it. One copy will stay with us for our records and one goes with consignor.
    2. Items consigned are expected to remain on consignment during the entire cycle for which you registered.
    3. After the cycle ends, at which time you are able to view your sales online, there will be a grace period of approximately 2 weeks at the end of each cycle for item pick up if you do not intend to register for the next cycle. You may pick up any unsold items within these 2 weeks without incurring a registration fee. Please see above comments for items considered for discard.
    4. You will receive an email letting you know that sales have been reconciled and data has been uploaded online to this website. From that time, you will have 2 weeks to pick up any or all items without penalty/fee. Please make a scheduled appointment and bring with you a copy of your unsold inventory. We will assist you in pointing you in their appropriate display locations, but consignors are responsible to locate their own items, bring them to the counter, and have ID ready to show who you are. We will remove the bar coded ticket from the item and have you to sign it/and/or our inventory sheet that you have picked that item up from inventory. If you prefer for us to locate item(s) for you, we will gladly do so for the listed fee below. While we are glad to consign your items, store routines must remain as normal as possible, so please respect these guidelines.
    5. For any or all items picked up early during the consignment cycle for which you have registered, you will be charged the full registration fee in place at time of pick up, or if between cycles. This fee is designed to offset the charge of handling your item(s) and is charged for early pick up in lieu of a prepaid fee when registering for consignment.
    6. Please note, if you schedule a pick-up time and I locate items for you and have them ready for you to pick up and you do not show, I will add an extra $15 per 1-5 items fee to your account for my time. This is above the ordinary fee for early pick up is the registration fee
    7. All fees must be paid before you will be allowed to leave the store with items.

When and how to View sales at END of CYCLE/register for next consignment cycle
    1. Sales updates are only done at the end of every consignment cycle (every 3 months/4 times a year). For example, if the cycle is from June-August, sold item tickets would not be scanned until AFTER that time. This process is not automatic so allow up to 2 weeks after any given cycle ends before beginning to call or email to ask about your sales and checks, please. No data will be given out before this time because we have not reconciled any data yet. Once sales data is reconciled, you will be able to view them online. Details follow.
    2. After the consignment cycle is over, many links to the online consignment site are disabled while sales and data are being reconciled and will continue to be disabled until data is uploaded again. Reconciling data is a process and according to what we encounter during this process, it may take several days up to a week, and certainly within 2 weeks.
    3. Mass emails are sent to keep you updated at the end/beginning of each cycle. You will get an email alert to remind you when it is time to view your sales, register for the current cycle or pick items up if you no longer wish to consign. (NOTE, all emails are sent in mass. Just because you get an email does NOT mean your item sold).
    4. At that time, and not until that time, you will be able to log into your account and see what items have sold since the last cycle.
    5. To view sales status at the end of the cycle, Login at http://boutiquegalleries.blogspot.com/
    6. Log in and click left link - Consignor Login: enter items, print tags, check sales. Then click the homepage link. There, toward the bottom, you will see links to view sold and unsold items. Go to your consignor login homepage. Sells data is displayed near the bottom. If sales have been uploaded and you still see no data, it is because there was no data to report.
    7. Once registration opens again, registering is quite simple. Just click to register for the current consignment cycle. REMEMBER to also click to make inactive items active again. It's that easy.
    8. But also remember that if you change any item's description or price, the ticket barcode is changed so the old ticket (the ticket on the item) would not be able to scan. So please do not do this.
    9. Checks will then be mailed to the address we have on file for you. This entire process is done manually and may take up to 2 weeks, depending on issues encountered, so please do not call or email until after the 2 weeks, as we will update the data online as soon as it has been reconciled. Then and only then can we know what items have sold.

Boutique Galleries Responsibility and rights (and non-responsibility)
Boutique Galleries assumes many responsibilities, and expects consignors to adapt to theirs. It is the responsibility of this storefront business to remain such. Consigning is the extra mile and we cannot stop normal routine to answer questions and check records for consignors that we have already taken great effort to provide for you online.
    1. Boutique Galleries assumes responsibility to re-register you and make your items active so that any sold items can be scanned at point of sale at the end of each cycle. We may do this from the time of actual sale up to the end of cycle. Generally, we wait until the end of cycle and do all at the same time frame. If you wish to register yourself, please follow the few easy steps to register AND make your items active from cycle to cycle.
    2. Boutique Galleries agrees to pay you our agreed upon percentage. Note, this is subject to change from cycle to cycle.
    3. Boutique Galleries representatives reserve the right to refuse any item for any reason, especially if stained, damaged or is not in fashion with the items we want to keep in inventory.
    4. Boutique Galleries representatives reserve the right to change price of any item at time of drop-off, especially if item is under-priced or over-priced for our selling market.
    5. Boutique Galleries reserves the right to price at our discretion any item dropped off for us to enter for you.
    6. Boutique Galleries assumes responsibility to display your items in best fashion for resale. This is left up to our discretion for the best overall management of all items under our roof.
    7. Boutique Galleries takes full responsibility of any item we rent that is on consignment.
    8. It is not the responsibility of our staff to look up your consignment number or password, as the online system is user friendly and you can do this as well as we can. See instructions below.
    9. It is not the responsibility of our staff to check to see if your item has sold. All consignors are expected to follow protocol procedures of consignment cycles.
    10. It is not the responsibility of Boutique Galleries to repeat what has already been thought out and written for you on the consignment website. Please familiarize yourself with the website and its links to equip yourself with this information.
    11. It is not the responsibility of Boutique Galleries to add your items without a service fee, change any information for you, etc...
    12. Note, Boutique Galleries will not be responsible to print a new tag and place on any item that has had a change in price or description. NOTE, anytime details are changed on an item in the computer, a new bar coded tag is assigned which means that the new tag must be printed and put on the item so the scanner can read it. If Boutique Galleries comes across such a ticket at time of scan, the scanned ticket data description will likely be blank or minimal.
    13. For items left on consignment with no buyer interest after 1 or more cycles, expect items to be discounted, removed from display floor to storage area to be later listed online (see more details herein), and/or donated/discarded, at our discretion. As a general protocol, as long as there is buyer interest, we usually keep items on display for at least 8 full season cycles (2 years) before looking to sell, either in store or online, for maximum markdown/donate/discard. However, we may take the liberty of marking incrementally down in order to sell. Items of consignors, who have no buyer interest/have not sold/been registered and/or kept active for 2 or more cycle years, may be considered donated/discarded or reduced drastically/listed and sold online at maximum clearance markdown price. Please see more details above about payout for such items.
    14. Boutique Galleries reserves full right to change description in terms of size or other details in order to help describe its accuracy in order to sell.
    15. Boutique Galleries is NOT responsible for any items broken, lost, stolen, damaged, misplaced, or destroyed by fire, winds, or other unfortunate events out of our control.
    16. While we are glad to consign your items, store routines and lives of staff must presume as normally as possible. We appreciate your understanding.

Consignor's responsibilities - the online system is YOUR selling partner. Please familiarize yourself with this website, its links, and the information contained within.
    1. It is the responsibility of the consignor to read this seller contract. If you type "yes" below, it is signifying that you have read and agree to it, so it is in your best interest to actually read it.
    2. It is the consignor's responsibility to ensure that the information we have on file for you is correct and updated. We are not responsible if we mail a check to the wrong address because of this error. If there is no address on file for you, we cannot mail you a check.
    3. It is each individual consignor's choice whether to update their own consignment status (register for the current consignment cycle, select items to be active in such current sale)
    4. If you change price or description for any ticketed item, that item's bar-code also changes. If you want the new data to display on the sales record, it is the consignor's responsibility to then replace the old ticket with the new one. Otherwise, if Boutique Galleries comes across such a ticket at time of scan, the scanned ticket data description will likely be blank or minimal.
    5. Please see below for a full list of fees.
    6. Items should NOT be on WIRE HANGERS.
    7. If you bring item in gown bag and want this back, take this back home with you at time of drop off. We display most gowns in our own bags and these will not be allowed to leave the store with consignor at pick up. Gown bags left here are recycled out to customers.
    8. Give detailed descriptive information of your item when entering it into the online system. See more information above or below.
    9. Tags should be printed on card stock paper to help prevent it from coming off the item. We would rather that consignors print their own tags and bring with them at drop off, but we will print these for you if you do not have card stock paper.
    10. It is the responsibility of the consignor to pick their items up within the announced time frame after a cycle if they no longer wish to keep on consignment here. For items left on consignment with no buyer interest after 1 or more cycles, expect items to be discounted. For items not sold after 2 or more cycles, expect item(s) to possibly be drastically reduced, removed from display floor to storage area to be later listed online (see more details herein), and/or donated/discarded. This is at our discretion to ensure that the store remains fresh and inviting and not cluttered. As a general protocol, we usually keep items on display for at least 8 full season cycles (2 years) before looking to sell in store (or online) for maximum clearance markdown/donate/discard. However, we may take the liberty of marking incrementally down in order to sell.
    11. Please see more details about drastic markdowns/pay outs above.

If item sells though an online site such as ebay, facebook, instagram, or mercari, and thus involves extra time/materials/fees/possibly modeling to list and ship, an extra 20% will be deducted from the actual sell price of such item to defray time/cost involved. This is more likely if item has been here for several cycles.
Stop payment of check $45 (or current bank fee plus extra $15)

    * - Same fee applies if the consignor registers himself/herself or is registered per Boutique Galleries
** FInd/pull items  - We do not stop normal business to locate items, but will gladly at no charge work WITH and assist YOU in gathering your items.
*** early pick up - the current registration fee in place at time of pick up, or if between cycles, the previous cycle registration fee. This fee is designed to offset the charge of handling your item(s) and is charged for early pick up in lieu of a prepaid fee when registering for consignment. All fees must be paid before you will be allowed to leave the store with items.
**** clean/steam item  - Our cleaning fee is generally $5-$25, depending on the garment. Occasionally, we miss stains, damage, or flaws during inspection at time of drop off. In such event that we notice the issue later and fix it, a fee for our service will be deducted from your check of sold items. This rarely happens, but in order to keep your item in sellable condition, any problem found must be addressed so the item can remain on display.
***** Beads, sequins, and jewels do fall off. This happens even on new dresses. Depending on what needs to be done, at the discretion of Boutique Galleries, we may take the initiative to fix this for you in lieu of selling an item as is at a discounted price. If so, a fee will incur. Occasionally, we miss such flaws during inspection at time of drop off. In such event that we notice the issue later and fix it, a fee for our service will be deducted from your check of sold items.
****** If we have to hand-write a check because you did not register for the cycle for which you are paid, there will be a charge to do this. Registering enables sold tickets to be scanned and checks to be printed in mass routinely at the same time at the end of the cycle.
******* Once a consignor's account has been deactivated/deleted due to inactivity as described herein, there will be a $15 fee to open an investigation of the records/account. This fee must be paid in advance of such investigation.

****** For your convenience, we can enter and tag your items for you
No time to tag? Too many questions? That's ok. Use our experience to your advantage to finish that task for you. Our knowledge can help you earn money on your no longer needed formal wear items.
For this service, you will receive 5% less of the total amount of your sold items, or a flat service of $20 (at the discretion of Boutique Galleries)
    Here;s how it works:
Maximum number of items for tagging service is 20 (unless you get approval otherwise)
